Estate Sales

Previously prohibited in Bellewood, the most recent Covenants provide a vehicle for homeowners to conduct an Estate Sale.  Any request to conduct an estate sale shall be submitted to and approved, in advance, by the BHOA Board.

  • We recognize that estate sales are of benefit to some homeowners, but at the same time may be an inconvenience to others. The BHOA Board has created a set of Bellewood HOA Estate Sale Rules (see below) which aim to balance the needs of all homeowners and ensure sales are conducted safely and with the most success possible. Click here to download the Estate Sale Parking Map
BHOA Estate Sale Rules
  • Homeowners shall provide the BHOA Board at least 30 days to process and approve an estate sale request. Estate sales for the purpose of complete liquidation of a home’s contents prior to the sale of the home, not a moving sale/garage sale, will be considered for approval.
     
  • Homeowners shall be in HOA financial good standing (as defined by being current on dues, assessments, fines, etc.) in order to submit an estate sale request.
     
  • The homeowner shall provide both a $500 non-refundable deposit and a $500 refundable deposit (separate checks made out to Bellewood HOA) with the estate sale request. The refundable deposit will be returned within seven days after the sale provided all BHOA Estate Sale Rules, BHOA Rules, Covenants and regulations have been followed or in the event the request for an estate sale is denied. Damages or liability incurred due to the estate sale may exceed $500 and the $500 refundable deposit shall not be construed as complete payment.
     
  • Estate sales shall be conducted from 10 am until 4 pm for two days only on a consecutive Saturday and Sunday. The BHOA Board reserves the right to immediately end the operation of a sale should it be deemed necessary to maintain the safety of Bellewood residents and their invitees. This action shall not create any liability of lost revenue, or any other liability, on behalf of the BHOA and the $500 homeowner deposit shall be forfeited.
     
  • Estate sale signage shall be limited to one sign outside of the community, one sign at the corner of Bellewood Park and Bellewood Square (if needed) and one sign in front of the estate sale property. Signs shall be displayed at 10am and shall be removed by 5pm on each sale date. Signs shall be no larger than a customary real estate yard sign and no other advertising mechanisms, such as balloons, etc., shall be displayed.
     
  • Bellewood estate sales shall be confined to the homeowner’s personal property on the premises at the time permission for the sale is granted. It is specifically prohibited to transport other items into the community, such as items from warehouses or retail outlets, or merchandise not belonging to the Bellewood estate being liquidated. All estate sale items must be contained inside the residence.
     
  • The homeowner shall provide someone (Gate Keeper) to be on-site and outside of the estate sale during the entirety of the sale. This person shall be positioned primarily at the front gate (entrance gates will be held open) to manage traffic flow, but also available to address any concerns exterior to the sale like parking, etc. It shall be the responsibility of the Gate Keeper to ensure estate sale customers are not admitted to the community if sufficient parking is not available. 
     
  • The BHOA Board shall designate (see the estate sale parking map) where estate sale parking is permitted within the community. Estate sale parking is prohibited in any other area including in front of mailboxes, blocking access to driveways and on the bricks of the community sidewalks. Parking will be allowed using limited parking passes and parking cones will be provided by the HOA for use during the sale (see map for additional instructions). It is the responsibility of the homeowner to communicate estate sale parking restrictions to the estate sale manager and their customers. It is the responsibility of the homeowner, estate sale personnel and Gate Keeper to enforce the parking requirements. 
     
  • The homeowner shall provide the cell phone number of someone (Estate Sale Community Contact) who will be on-site during the entirety of the estate sale. This contact information will be provided to all Bellewood homeowners and available for use should concerns arise during the sale.
     
  • The homeowner shall ensure they, along with the estate sale personnel and customers, abide by all BHOA Estate Sale Rules, BHOA Rules, Covenants and regulations. Failure to comply with these guidelines will result in the estate sale being stopped, with no liability incurred by the HOA, and the $500.00 deposit forfeited.
     
  • The homeowner shall be liable for any damage to Bellewood HOA property and amenities, and any homeowner property, caused by estate sale personnel, attendees, movers, etc. The homeowner holding the estate sale, not the Bellewood HOA, shall be held responsible for any damage or injury to persons or property due to the estate sale. The homeowner shall provide to the Bellewood HOA, proof of liability insurance carried by the estate sale company.
     
  • If the Bellewood homeowner is deceased or incapacitated, the homeowner representative submitting the estate sale request agrees to assume all of the responsibility and liability described in this request. The representative shall then become the homeowner as it pertains to this application and to any other matters related to the estate sale. In submitting an estate sale request, the homeowner’s representative declares they have the legal authority and right to liquidate the homeowner’s property in an estate sale.
